General Terms and Conditions (GTC) for orders via www.lucky-dog.shop

Below, we would like to introduce our general terms and conditions, which we use to process and complete your purchase. At www.lucky-dog.shop, we offer the purchase of pet supplies, specifically dog supplies, dog accessories, and dog toys.

1. CONCLUSION OF CONTRACT AND DELIVERIES OF GOODS

1.1 Contracts via www.lucky-dog.shop are concluded exclusively in German. When ordering pet supplies, your contractual partner is Melanie Engels, Johann-Dohr Str. 15, 41066 Mönchengladbach.

1.2 By clicking the "Buy now" button, you place a binding order for the items in your shopping cart. We will confirm receipt of your order immediately by email after you submit your order. A binding contract is concluded upon receipt of the order confirmation. Please note that with advance payment (reservation), the ordered goods will be delivered as soon as we receive payment of the full purchase price, including any shipping costs. Therefore, we ask you to transfer the purchase price immediately after receiving the order confirmation, but no later than within 7 days.

1.3 Please note that, as an exception, we are not obligated to deliver the ordered goods if we have properly ordered the goods ourselves, but have not been delivered correctly or on time (congruent hedging transaction). A further prerequisite is that we are not responsible for the unavailability of the goods and have informed you of this fact immediately. Furthermore, we must not have assumed the risk of procuring the ordered goods. In the event of such unavailability of the goods, we will immediately refund any payments already made.

1.4 We do not assume the risk of having to procure ordered goods (procurement risk). This also applies to orders for goods that are only described by their type and characteristics (generic goods). We are only obligated to deliver from our inventory and from goods ordered by us from our suppliers. We deliver orders within Germany. If delivery times are specified as working days, this means all days from Monday to Friday inclusive, excluding public holidays.

1.5 You will be informed about the delivery time on the respective product detail page and before placing your order.

2. PRICES, SHIPPING COSTS AND EXPRESS SHIPPING

2.1 The prices listed in the offer at the time of the order apply. The prices stated are final prices, i.e., they include the applicable German VAT. The goods remain our property until the purchase price has been paid in full.

2.2 Shipping costs per item are generally free of charge, otherwise stated separately.

2.3 We do not offer express shipping.

3. PAYMENT

3.1 We generally offer payment in advance, credit card, and PayPal. We reserve the right to refuse certain payment methods for each order and to refer to other payment methods. Please note that we only accept payments from accounts within the European Union (EU). You are responsible for any fees associated with a money transaction.

3.2 In the case of purchase by credit card, your credit card account will be debited when we ship the order.

3.3 We reserve the right to charge a flat-rate reminder fee of EUR 5.00 per reminder as damages for late payment if you are in arrears with your payment. You are permitted to provide evidence that the damage incurred is significantly less than the flat rate, or that no damage at all has occurred.

3.4 You agree to receive invoices and credit notes exclusively in electronic form.

4. PROMOTIONAL VOUCHERS AND THEIR REDEMPTION

4.1 Promotional vouchers are vouchers that cannot be purchased, but which we issue as part of advertising campaigns with a specific period of validity.

4.2 Promotional vouchers can only be redeemed during the specified period and only once per order. Please note that promotional vouchers may be subject to a minimum order value.

4.3 The value of the goods must be at least equal to the amount of the promotional voucher. Any difference to a higher value of the goods can be settled using the payment options offered. The value of a promotional voucher is neither redeemable in cash nor bears interest. The promotional voucher will not be refunded if goods are returned in whole or in part.

4.4 Promotional vouchers can only be redeemed before completing the order process. Retroactive crediting is not possible. The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined unless we have agreed otherwise.

4.5 If you used a promotional voucher for your purchase, we reserve the right to charge you the original price of the goods you retain if – due to your cancellation – the total value of the order falls below or equals the value of the promotional voucher.

5. GIFT VOUCHERS AND THEIR REDEMPTION

5.1 Gift vouchers are vouchers that you can purchase. These can only be redeemed for purchases on lucky-dog.shop and not for the purchase of additional gift vouchers. If the balance on a gift voucher is insufficient for the order, the difference can be made up using the payment options offered.

5.2 Gift vouchers and credit balances can only be redeemed before completing the order process. Gift voucher balances are neither redeemable in cash nor accrue interest. To redeem gift vouchers in your customer account, please visit "My Vouchers" at www.lucky-dog.shop.

6. STATUTORY RIGHT OF WITHDRAWAL FOR ORDERS

WHEN YOU PURCHASE PET SUPPLIES, YOU HAVE A STATUTORY RIGHT OF WITHDRAWAL:
We would like to inform you in advance that if you wish to return goods, you can use the return label that is either included with your order or can be printed out via your customer account. If you don't have access to a printer, have difficulty downloading the return label, or need a new return label, you can also request one through our Customer Service. Please help us avoid unnecessary costs and do not return the goods without a return label.

CANCELLATION POLICY:
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the delivery date. To exercise your right of withdrawal, you must inform Melanie Engels, Joahnn-Dohr Str. 15, 41066 Mönchengladbach, Telephone: +49 15562 358672 , Email: info@www.lucky-dog.shop by means of a clear declaration (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose. However, this is not mandatory. You can also electronically fill out and submit the model withdrawal form or another clear declaration via the contact form on our website. If you make use of this option, we will send you an immediate confirmation (e.g. by email) of receipt of your withdrawal. To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.
Consequences of cancellation If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you. Under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. We will cover the cost of returning the goods if you use the return label provided by us for returns within Germany. Otherwise, you will be responsible for the return shipping costs. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their quality, properties, and functioning.

End of the cancellation policy

Attention: The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

7. REPAYMENTS

We will automatically process any refunds to the account you used for payment. If you paid in advance, the refund will be sent to the account from which the transfer was made. If you paid via PayPal or credit card, the refund will be made to the associated PayPal or credit card account. If you used a gift card for your purchase, we will credit the corresponding amount to your gift card account.

9.1 The statutory liability for defects applies.

9.2 You can view these Terms and Conditions at lucky-dog.shop. You can also print or save this document using the usual functions of your Internet service program (= browser: usually "File" -> "Save As"). You can also download and archive this document in PDF format by clicking here. To open the PDF file, you will need the free program Adobe Reader (available at www.adobe.com) or a comparable program that supports the PDF format.

9.3 You can also easily archive the Terms and Conditions and your order details by either downloading the Terms and Conditions and saving the data summarized on the last page of the online shop's order process using your browser's functions, or by waiting for the automatic order confirmation, which we will also send to you by email after completing your order to the email address you provided. This order confirmation email will contain your order details and our Terms and Conditions again and can be easily printed or saved using your email program.

9.4 The European Commission provides a platform for online dispute resolution (ODR), which you can find at the following link to the European Commission platform. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
